Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Flan, including the Flan iPhone application, the website at getflan.app, and related services operated by Dang Apps LLC ("Dang Apps," "we," "us," or "our").

By accessing or using Flan, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old to use Flan. By using the service, you represent and warrant that:

• you are at least 18 years old;
• you can form a binding contract with Dang Apps; and
• you are not barred from using the service under applicable law.

Flan is not intended for minors.

3. Description of the Service

Flan is a private service for couples. Depending on the version of the service and feature availability, Flan may include private messaging, voice notes, photo and memory storage, rituals or check-ins, shared calendars, events, to-dos, and related website or app functionality.

We may add, remove, or modify features at any time.

4. Accounts and Access

You may need to create an account to use some or all parts of Flan. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information and to keep it updated. We may suspend, restrict, or terminate access if we believe your use creates legal, security, platform, or operational risk, or if you violate these Terms.

5. User Content

Flan allows you to create, upload, store, send, and organize content such as messages, photos, voice notes, memories, calendar items, events, to-dos, and other private couple content ("User Content").

You retain ownership of your User Content. However, you grant Dang Apps a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display your User Content solely as needed to operate, maintain, improve, secure, and support Flan.

You are responsible for your User Content and represent that you have all rights necessary to submit it. You may not upload, store, or share User Content that is unlawful, infringing, abusive, harassing, threatening, exploitative, deceptive, or otherwise harmful.

6. Acceptable Use Restrictions

You may not:

• use the service in violation of any law, regulation, or third-party right;
• infringe intellectual property, privacy, publicity, or contractual rights;
• reverse engineer, decompile, or attempt to derive source code except where applicable law forbids that restriction;
• interfere with or disrupt the service, servers, or networks;
• attempt unauthorized access to accounts, systems, or data;
• scrape, crawl, automate abuse of, or overload the service;
• use Flan to harass, threaten, impersonate, exploit, or harm others; or
• upload malware, malicious code, or other harmful materials.

7. Third-Party Services and Platforms

Flan may depend on or integrate with third-party services and platforms, including Apple App Store distribution, social login providers, analytics tools, hosting vendors, and other service providers. Your use of those third-party services may be subject to their own terms and privacy policies.

Dang Apps is not responsible for third-party services, content, policies, or availability.

If you access Flan through an iPhone app distributed via Apple, you acknowledge that these Terms are between you and Dang Apps, not Apple, and Apple is not responsible for the Flan service, its content, maintenance, support, or claims relating to it, except as required by applicable App Store terms.

8. Availability and Changes

We do not guarantee that Flan will always be available, uninterrupted, secure, or error-free. We may suspend or discontinue any part of the service, impose usage limits, or change features, functionality, and technical requirements at any time.

9. Future Paid Features

Flan is currently offered without subscription-specific billing terms in these Terms. Dang Apps may introduce paid, premium, or subscription-based features in the future. If that happens, additional billing, renewal, cancellation, or refund terms may apply to those offerings.

10. Intellectual Property

Flan, including its software, design, branding, visual elements, site content, trademarks, and related intellectual property, is owned by or licensed to Dang Apps LLC and is protected by applicable intellectual property and other laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for its intended purpose.

11. Termination

You may stop using Flan at any time. We may suspend, restrict, or terminate your access if you violate these Terms, misuse the service, create legal or security risk, or if we discontinue the service.

Sections that by their nature should survive termination will survive, including provisions on ownership, disclaimers, limitation of liability, indemnification, and dispute resolution.

12. Disclaimers

Flan is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Dang Apps disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that Flan will be uninterrupted, error-free, secure, bug-free, or that content will never be lost or inaccessible.

13. Limitation of Liability

To the fullest extent permitted by law, Dang Apps LLC and its officers, members, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, goodwill, data, use, or other intangible losses arising out of or related to your use of Flan.

To the fullest extent permitted by law, the total aggregate liability of Dang Apps for all claims arising out of or relating to Flan or these Terms will not exceed the greater of (a) the amount you paid us for the service in the 12 months before the event giving rise to the claim, or (b) $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless Dang Apps LLC and its affiliates, officers, members, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, your misuse of the service, your violation of these Terms, or your violation of any law or third-party right.

15. Dispute Resolution

These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws rules.

Please contact us first at support@dangapps.com if you have a dispute. Most concerns can be resolved informally.

If a dispute cannot be resolved informally, you and Dang Apps agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved by binding individual arbitration, except that either party may bring an individual action in small claims court if it qualifies, and either party may seek injunctive or equitable relief in court for misuse of intellectual property or unauthorized access to the service.

You and Dang Apps each waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative proceeding.

Any court proceedings permitted under these Terms must be brought in a court of competent jurisdiction located in Illinois, and you consent to that venue and jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. By continuing to use Flan after updated Terms become effective, you agree to the revised Terms.
